Baitcraft is a free single-player fishing game with an account that keeps your progress. These terms are the agreement between you and its publisher for using it, and they are also the end user licence agreement for the app.
1Agreement and parties
Baitcraft (the "Game") is published by Symbiot Development OÜ, a private limited company registered in Estonia, of Tartu mnt 67/1-13b, Kesklinna linnaosa, 10115 Tallinn, Harju maakond, Estonia ("Symbiot", "we", "us"). These Terms & Conditions (the "Terms") govern your use of the Game on iOS and Android, of the account the Game creates for you, and of the website at baitcraft.app.
By downloading, installing or playing the Game you accept these Terms. If you do not accept them, do not install the Game, and uninstall it if you already have.
These Terms are also the end user licence agreement for the Game. Our Privacy Policy describes what the Game and the account do with data and forms part of these Terms.
2Who may play
You must be at least 13 years old to have a Baitcraft account. The Game is rated 4+ on the App Store and Everyone on Google Play, and it contains no purchases, no chat and nothing written by other players, but it is not directed at children under 13 and we do not knowingly create an account for one.
If you are under the age of majority where you live, you may use the Game only if a parent or guardian accepts these Terms on your behalf. A parent or guardian who does so is responsible for how the Game is used on that device and may delete the account at any time, in the Game's menu.
3Your account
The Game creates an account for you so that your progress is not tied to one phone. You choose how, on the first screen: sign in with Apple, sign in with Google, or play as a guest.
A guest account is reachable only from the installation that created it. It cannot be moved to another device, and it does not survive uninstalling the Game — the ticket that reached it goes with the installation, and neither you nor we can reach it afterwards. The Game says so before you choose it. Signing in later attaches your progress to an identity and removes that limit.
Your account is yours alone. Do not let anyone else use it, do not use anyone else's, and do not sign in with an identity that is not yours. Your account carries a handle we assign to it, in the form player_ followed by digits; we may change it if we have to, and you may not choose it.
One account plays on one device at a time. Opening the Game on a second device signs the first one out of play, which is expected behaviour and not a fault. You may sign out at any time; you may delete your account at any time, as described below.
4Your licence
We grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable and revocable licence to install and play the Game on devices you own or control, for your own private, non-commercial entertainment. That is the whole of the licence; every other right stays with us.
You may not:
- copy, distribute, rent, lend, sell or otherwise make the Game available to anyone else, except as your app store's own rules allow, for example through family sharing;
- reverse engineer, decompile or disassemble the Game, or attempt to derive its source code, except to the extent that applicable law expressly permits this despite the restriction;
- modify the Game, or edit, inject into or otherwise tamper with its saved data, in order to give yourself progress, gear or currency that the Game did not award;
- interfere with the account service: forge, replay or alter what the Game reports to it, use it other than through the Game itself, register accounts in bulk or by automated means, or attempt to reach an account that is not yours;
- probe, overload or attempt to breach the security of the account service, or work around any limit it applies;
- extract, republish or reuse the Game's artwork, sounds, text, fish and water catalogues or other content outside the Game;
- automate play with scripts, bots or simulated input;
- remove or obscure any notice of ownership in the Game.
Screenshots and video of your own play, including streams and let's-play videos, need no permission from us, whether or not you make money from them.
5The Game
The Game is free. There is nothing to buy in it, and we take no payment of any kind, at any time.
The fishing is single-player and works offline: you can play with no connection at all, and the Game hands what happened to your account the next time it reaches us. Some things need a connection and say so when they do.
We develop the Game continuously. Waters, fish, gear, balance, in-game prices, rewards and rules may be added, changed or removed in any update, and something that works today may work differently, or not at all, after the next one. We do not promise that the Game or the account service will always be available, that either will run on every device or operating system version, or that we will go on publishing the Game.
6In-game items and currency
Silver, gold, gear, catches and every other in-game item are part of the Game itself. They are neither goods nor money. They are earned by playing, and they cannot be bought.
In particular:
- they have no monetary value and cannot be exchanged for money or for anything else of value, inside or outside the Game;
- you do not own them; the licence above lets you use them inside the Game, and no more;
- they cannot be sold, traded, gifted or transferred to another player, another account or another installation;
- we may change what an item does, what it costs in-game or how it is earned, and we may remove it, as part of developing the Game;
- deleting your account destroys them, and no refund arises, because nothing was ever paid.
One reward is random: on the last day of a daily reward streak, the reward box pays out one of several possible prizes. The box is free, it cannot be bought or unlocked with money, and there is no stake, no wager and no purchase anywhere in the Game.
7Your progress, and what we do not promise about it
Your account holds a record of your progress, and the Game keeps its own copy on your device so that it plays without a connection. Where the two disagree, the account's record is the one that stands: your device's copy is a projection of it, and the Game will adopt what the account says.
We take reasonable care of that record, but we do not promise it. Before you rely on it, know what follows. Progress that has not yet reached your account — because you played offline, or the Game was closed before it could hand it over — can be lost with the device. A guest account is lost with the installation. Deleting your account destroys everything on it, immediately and permanently, and we cannot bring it back. Any device backup is the one your operating system makes, under Apple's or Google's terms rather than ours.
If our records show that progress was obtained by tampering with the Game or with what it reports, we may correct it, and we may take the action described under "Ending this agreement".
8Acceptable use
Do not use the Game in a way that breaks the law where you are, that interferes with anyone else's device, account or software, or that presents the Game or its content as your own. Do not impersonate us, and do not distribute a modified build of the Game.
9Ownership of the Game
The Game and everything in it belongs to us or to our licensors: the software, the artwork, including the guide's illustrations and the prologue paintings, the sounds, the written content, the fish and water catalogues, the name Baitcraft, and the logos and other brand features. All of it is protected by copyright and other intellectual property law.
Nothing in these Terms transfers any of that to you. The Game also includes open-source software components, each under its own licence; where such a licence gives you rights broader than the licence above, that licence governs that component.
10App stores and sign-in providers
You obtain the Game through Apple's App Store or through Google Play, and the terms of the store you used apply to you alongside these Terms. Neither store is a party to these Terms.
If you sign in with Apple or with Google, your relationship with that provider is governed by its own terms, and we are not responsible for it. If a provider closes your account with it, or you revoke the Game's access, you may no longer be able to reach your Baitcraft account through that identity.
Google is not responsible for the Game, and Google Play's own terms, including its refund rules, govern your download from it. Apple's position is set out in the next section. Where a store's rules conflict with the licence above, the store's rules prevail to the extent of the conflict.
11Additional terms for the App Store version
The following applies if you obtained the Game from Apple's App Store. Apple requires it, and it prevails over anything inconsistent elsewhere in these Terms.
- These Terms are concluded between you and us alone, not with Apple. Apple is not responsible for the Game or its content.
- The licence granted above is a non-transferable licence to use the Game on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions, except that the Game may be accessed by other accounts associated with you through family sharing or volume purchasing.
- We alone are responsible for maintenance and support of the Game. Apple has no obligation to furnish any maintenance or support services for it.
- If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the Game to you, which for Baitcraft is nothing, because the Game is free. To the maximum extent permitted by applicable law, Apple has no other warranty obligation whatsoever with respect to the Game.
- We, not Apple, are responsible for addressing any claim by you or a third party relating to the Game or your possession and use of it, including product liability claims, any claim that the Game fails to conform to a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
- We, not Apple, are responsible for the investigation, defence, settlement and discharge of any claim that the Game or your possession and use of it infringes a third party's intellectual property rights.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Our name and contact details for questions, complaints or claims about the Game are set out in the Contact section below.
- You must comply with any applicable third-party terms of agreement when using the Game.
- Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms Apple will have the right, and is deemed to have accepted the right, to enforce these Terms against you as a third-party beneficiary of them.
12No warranty
The Game is provided free of charge, as is and as available, without warranty of any kind. To the maximum extent permitted by law we disclaim all implied warranties, including any implied warranty of merchantability, satisfactory quality, fitness for a particular purpose and non-infringement. We do not warrant that the Game or the account service will be uninterrupted or error free, that defects will be corrected, that your progress will always be preserved, or that either is free of harmful components.
This section does not affect the rights you have as a consumer under the law of your own country that cannot be excluded or limited by agreement. Where that law gives you guarantees we may not exclude, they apply to you in full.
13Our liability
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, for loss of profit or opportunity, or for the loss or corruption of your progress, whether on your device or on your account, in each case arising out of or in connection with the Game.
Where we are liable to you despite the above, our total liability for all claims arising out of or in connection with the Game and these Terms is limited to EUR 100.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that may not lawfully be excluded or limited.
14Your responsibility to us
If you use the Game in breach of these Terms and a third party brings a claim against us because of it, you agree to cover the reasonable losses, damages and costs, including reasonable legal fees, that we incur as a result. This does not apply to anything you do as a consumer in the ordinary use of the Game, nor to the extent that the claim arises from our own act or omission.
15Ending this agreement
You may end these Terms at any time by deleting your account and uninstalling the Game. Game Menu, then Delete Account, erases the account and everything on it, on our server and on your device, immediately and permanently.
We may suspend or end your account and your licence if you materially breach these Terms, and we will act proportionately: where the breach is one we can simply correct, such as progress obtained by tampering, we will normally correct it rather than close the account. We may also discontinue the Game or the account service, in which case the licence ends when the Game is no longer available to you. Where the law requires it, we will give you notice and a way to object.
When the licence ends you must stop using the Game and uninstall it. The sections on in-game items, ownership of the Game, warranties, our liability, your responsibility to us, and governing law survive the end of these Terms.
16Governing law and disputes
These Terms, and any dispute arising out of them or out of the Game, are governed by the law of Estonia, and the courts of Estonia, with Harju County Court as the court of first instance, have jurisdiction.
If you use the Game as a consumer, that choice does not deprive you of the protection given to you by the mandatory rules of the country you live in, and you may bring proceedings in the courts of that country. If you live in the European Union, you may also be able to take a dispute to the consumer dispute resolution body for your own country; in Estonia that is the Consumer Disputes Committee at the Consumer Protection and Technical Regulatory Authority.
Before going to court, please write to us at info@symbiot.dev. Almost everything is faster to settle that way.
17Changes to these Terms
We may change these Terms, for example to reflect a change in the Game, in the law or in an app store's rules. When we do, we update the date at the top of this page and publish the new version here, and a material change is also noted in the Game's release notes.
A change takes effect when it is published. If you keep playing afterwards, the current version applies to you; if you do not accept it, delete your account and uninstall the Game.
